Please read these Terms and Conditions carefully before using Safaari's ride-sharing services. By accessing or using our mobile application, website, or services, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use our services.

1. Acceptance of Terms

By creating an account, accessing, or using Safaari's services (including our mobile application, website, and ride-sharing platform), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. These terms constitute a legally binding agreement between you and Safaari.

Important: If you do not agree to these terms, you must immediately stop using our services and delete your account.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years old to use Safaari services. By using our services, you represent and warrant that you are 18 years of age or older.

2.2 Account Creation

To use our services, you must:

  • Create an account with accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Provide a valid phone number and email address

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify Safaari of any unauthorized use of your account or any other breach of security.

3. Use of Services

3.1 Service Description

Safaari provides a technology platform that connects riders with independent third-party drivers who provide transportation services. Safaari acts as an intermediary and does not provide transportation services directly.

3.2 Permitted Use

You agree to use our services only for lawful purposes and in accordance with these terms. You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the service or servers
  • Attempt to gain unauthorized access to any part of the service
  • Harass, abuse, or harm drivers or other users
  • Impersonate any person or entity
  • Use automated systems to access the service without permission
  • Share your account with others

3.3 Service Availability

Safaari services are available in Coimbatore and Ooty districts. We do not guarantee service availability at all times or in all locations. Service availability may be affected by various factors including weather, traffic, driver availability, and technical issues.

4. Booking and Cancellation

4.1 Ride Booking

When you book a ride through the Safaari app, you are requesting transportation services from an independent driver. The booking is confirmed when a driver accepts your ride request.

4.2 Cancellation Policy

  • Customer Cancellation: You may cancel a ride before the driver arrives. Cancellation fees may apply if you cancel after a driver has been assigned and is en route to your location.
  • Driver Cancellation: If a driver cancels your ride, we will attempt to match you with another available driver at no additional cost.
  • No-Show Policy: If you fail to appear at the pickup location within a reasonable time, the driver may cancel the ride, and cancellation charges may apply.

4.3 Ride Modifications

You may modify your destination or add stops during an active ride, subject to driver approval. Additional charges may apply for route changes or extended distances.

5. Pricing and Payment

5.1 Fare Calculation

Ride fares are calculated based on factors including distance, time, ride type (bike, auto, or car), demand, and applicable taxes. Fare estimates are provided before booking, but final fares may vary based on actual route taken and traffic conditions.

5.2 Payment Methods

We accept the following payment methods:

  • Cash payments
  • UPI (Unified Payments Interface)
  • Credit/Debit cards
  • Digital wallets
  • In-app payment options

5.3 Payment Processing

For cashless payments, you authorize Safaari to charge your selected payment method for the total fare amount. All payments are processed securely through our payment partners.

5.4 Refunds

Refunds may be issued in cases of service failures, driver cancellations, or billing errors, subject to our refund policy. Refund requests must be submitted through the app or customer support within 7 days of the ride completion.

6. Safety and Conduct

6.1 Safety Requirements

  • Wear appropriate safety gear (helmets for bike rides) as required by law
  • Fasten seatbelts when available in vehicles
  • Follow driver instructions regarding safety
  • Do not distract the driver during the ride
  • Report any safety concerns immediately

6.2 Prohibited Conduct

You agree not to engage in the following prohibited activities:

  • Smoking, consuming alcohol, or using illegal substances during rides
  • Damaging or vandalizing vehicles
  • Engaging in violent, threatening, or abusive behavior
  • Carrying weapons or dangerous items
  • Requesting drivers to violate traffic laws
  • Exceeding vehicle capacity limits

6.3 Safety Features

Safaari provides safety features including real-time ride tracking, emergency assistance, and driver verification. However, you are responsible for your own safety and should exercise reasonable caution when using our services.

7. Ratings and Reviews

After each ride, you may rate and review your driver. Ratings and reviews must be honest, accurate, and not contain offensive, defamatory, or inappropriate content. Safaari reserves the right to remove ratings or reviews that violate these terms.

8. Lost and Found

If you leave personal items in a vehicle, contact Safaari customer support immediately. We will attempt to facilitate the return of lost items, but Safaari is not responsible for lost, damaged, or stolen items left in vehicles. Drivers are independent contractors and are responsible for items left in their vehicles.

9. Limitation of Liability

9.1 Service Intermediary

Safaari is a technology platform that connects riders with independent drivers. We are not a transportation carrier and do not provide transportation services. Drivers are independent contractors, not employees or agents of Safaari.

9.2 Limitation of Liability

To the maximum extent permitted by law, Safaari shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our services.

9.3 Maximum Liability

Safaari's total liability for any claims arising from or related to the use of our services shall not exceed the amount you paid for the specific ride giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Safaari, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these terms, or infringement of any rights of another party.

11. Intellectual Property

All content, features, and functionality of the Safaari platform, including but not limited to text, graphics, logos, icons, images, software, and the overall design, are owned by Safaari or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

12. Privacy

Your use of Safaari services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

13. Modifications to Terms

Safaari reserves the right to modify these Terms and Conditions at any time. We will notify you of material changes by posting the updated terms on our website/app and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting customer support or using the account deletion feature in the app.

14.2 Termination by Safaari

Safaari may suspend or terminate your account and access to services immediately, without prior notice, if you violate these terms, engage in fraudulent activity, or for any other reason at our sole discretion.

14.3 Effect of Termination

Upon termination, your right to use the services will immediately cease. All provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Dispute Resolution

15.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu, India.

15.3 Dispute Resolution Process

Before initiating any legal proceedings, you agree to first contact Safaari to attempt to resolve the dispute amicably. We encourage resolution through our customer support channels.

16. General Provisions

16.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Safaari regarding the use of our services.

16.2 Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.3 Waiver

The failure of Safaari to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these terms or your account without Safaari's prior written consent. Safaari may assign these terms without restriction.
